The Crime Victims Assistance Section has responsibility for compensation and for ads federal and state victim services grants. The program was created in 1978.

FUNDING
The program receives 8% of offender-paid assessments imposed as follows: $100 for felonies, $60 for misdemeanors, $90 for drunk driving, and $30 for offenses punishable only by a fine. The program returns 50% of those collections to prosecutors maintaining comprehensive victim service programs. The program also receives 60% of punitive damages awarded in civil cases. The program receives a VOCA grant annually.
ELIGIBILITY REQUIREMENTS
Reporting period: 72 hours Filing period: 6 months, with good-cause waiver Exceptions: For child victims, time periods begin at date of disclosure
PROCEDURES
Claims examiners review all applications, working with other examiners and the director on questionable claims. All decisions are reviewed by the director or assistant director. Appeals: No time limit within which to request reconsideration. Department has 30 days to reconsider. Applicant has 60 days after that to file appeal to the Workers Compensation Board.
BENEFITS
Maximum award: $44,000
Compensable Costs (with limits)
Medical expenses: $20,000
Mental health counseling: $20,000 for direct victims and family in homicides; $10,000 for children who witness domestic violence
Lost wages/support: $400 per week up to $20,000 limit
Funerals: $3,500
Travel: mileage reimbursement for medical/counseling treatment if over 60 miles round-trip, to maximum of $3,000
Rehabilitation: $4,000
Emergency: $1,000
